In line with the sub-paragraph “e” of the paragraph 2 of the Article 81 of the Law of Georgia on “Prosecutor’s Office” and in line with the paragraph 2 of the Article 2 of the Law of September 18, 2015 N4300-IS on Changes to the Law of Georgia on “Prosecutor’s Office”: October 5, 2015 is the date to onset the contest for two members of the Prosecutor’s Council to be elected by the Parliament of Georgia.
The Parliament of Georgia can elect the Georgian citizen with high education in law with master’s academic degree or the degree equal thereto/diploma of graduation from higher education with no less than 10 years of experience in the field of his/her qualification, high reputation and who is recognized as the specialist of the law field as the member of the Prosecutor’s Council.
The Member of the Parliament, the Judge and the Prosecutor shall not be nominated as the candidates to membership of the Prosecutor’s Council.
The candidates to the membership of the Prosecutor’s Council shall be selected amongst the professors and researchers of the Universities of Georgia, members of the Bar Association of Georgia and/or the persons, nominated by the NCLEs on the basis of submission by the Collective Head Administrative Body of the respective organization.
The Higher University of Georgia, the Bar Association of Georgia, NCLE are authorized, in line with the order established under the Law of Georgia on “Prosecutor’s Office”, till October 15, 2015 inclusive to submit no more than three candidates to membership of the Prosecutor’s Council to the Parliament.
The NCLE is authorized to submit the candidate to membership of the Prosecutor’s Council in the event if prior to the call for contest, one of the spheres of his/her activity during the last two years was implementation of the representative authority in the proceedings in the Courts. Nomination of the candidacy shall be attached with the letter of credence, the working biographic data of the candidate, the copy of the ID or the passport, the copies of the documents certifying at least 10 years of experience in the relevant field and the copy of the higher legal education, the list of the works published on law issues (if such), the written consent by the candidate and if the nominator is the NCLE – the document, certifying that one of the spheres of its activity during the last 2 years prior to the call for contest was implementation of the representative authority in the proceedings in the Courts.
The nomination shall be submitted addressed to the Speaker of the Parliament in writing to the address as follows: 26, Irakli Abashidze Avenue, Kutaisi.
