Iago Khvichia: we introduce the Bill to release persons from the detention illegally arrested on the basis of the Order of the Constitutional Court

The Political Group “Girchi” developed the Bill introduced by the Chair of the Group, Iago Khvichia at the briefing.


According to him, society is aware of the so-called Exchange Mob case, where the facts of “insertion” of the narcotic agents by the law-enforcement officers.


“This case has been appealed to the Constitutional Court for the determination of the standard for the form of evidence, with which the evidence shall be enclosed to the case to issue the respective sentence. The Constitutional Court stated that such search and seizure cannot be considered as evidence where information is provided on the basis of the story by the confident and at that, the search and seizure are attended by the police officers solely, and the police did not undertake a single measure to otherwise substantiate the evidence”, - Iago Khvichia stated.


According to him, the persons detained have been released as a result of the political processes and hence, the persons still detained with identical evidence shall as well be released.


“To prevent the release, the judicial system of Georgia and especially the Common Courts have elucidated this Order of the Constitutional Court as follows: if the authors of the Constitutional appeal were put to jail, they would still be inmates and on the basis of the Constitutional Court Order they won, they could not be released. We want to introduce the Bill for the enforcement of the Constitutional Court Order and the persons still detained, deriving from the retrospective principle of the Law, shall be released. We appeal to the society to see to this decision and the release of these people who were illegally arrested on the basis of the Constitutional Court Order”, - he stated.
