The Parliament considered the legislative initiative by the members of the parliamentary majority on the amendments to the Law on Spatial Planning, Architectural and Construction Activities of Georgia with I reading.

The legislative package, which consists of 7 documents, regulates the issue of functioning without the commissioning of buildings.

At the same time, the package defines a temporary rule of commissioning the construction work in violation of the permit conditions within the administrative boundaries of Tbilisi Municipality.

One of the initiators of the draft, Chair of the Environmental Protection and Natural Resources Committee, Maia Bitadze elucidated that “the legislative package is aimed at solving the problem that concerns tens of thousands of residents of Tbilisi. These are objects under their ownership, which have not been put into operation and they cannot fully use the property”.

According to her, the changes envisaged by the legislative package apply only to those facilities that are built in an area where a construction permit has been issued or a development regulation plan has been approved.

According to the package, the amnesty will apply to all types of construction - from the first to the fifth classes.

Facilities built before 18 August 2020 and members or developers of the condominium of these facilities will have the right to submit a relevant application after the adoption of the law and request the administrative body to carry out the necessary procedures for the commissioning of the facility.

If the parameters K1, K2, K3, exterior or interior, boundary zone, development adjustment lines, development height adjustment lines, functional zone, number of parking lots, or construction part of the project are violated, but their safety is confirmed by an accredited expert, the violation will be considered honorable and the penalties will be written off.

The scheduled change in the law also envisages a ban on the supply of electricity and natural gas to buildings that are yet to be put into operation.

The package also defines the obligations that will insure Tbilisi in the future from the operation of facilities that have not been put into operation.

The changes envisaged by the legislative package apply only to the capital.
