The Press-conference by Eka Beselia and Gedevan Popkhadze regarding the Constitutional Court

The Chair of Human Rights and Civil Integration Committee, Eka Beselia elucidated the changes to the law on Constitutional Court.

The changes aim at capacity building of and enhancement of trust to the Constitutional Court. “So, we are very attentive for the law implementation process and we have the feeling that there is a clear attempt to involve the Court in the political process”.

Unfortunately, one of the parties of the process is the CEO of the TV Company Rustavi2, Nika Gvaramia. “The statements and estimations made recently on CC speak that we deal with open attempt to involve the CC in the political process. The statement by N. Gvaramia that the Court of Appeals is afraid for the CC to be the first for decision-making, it was the direct recognition that he is aware of expected decisions”.

She reminded the law suit in which the Parliament is the respondent. The suit is the case of Rustavi2 and Sakartvelo TV companies vs. Parliament. The representative of the Parliament, upon consideration of the suit, put the issue of deterrence of some Judges.

She introduced the motion to the journalists with substantiated demand to deter the Judges Vardzelashvili and Kopaleishvili. “All the suits within interest of UNM, suits filed by TV, are somehow directed to one and the same Board with 3 Judges. When you ask, why the Judge put the motion to the plenum on case consideration by the plenum. Does it entail doubts that all the suits within UNM and Rustavi2 interests are directed to 3 Judges of one Board?”

The proxy of the Parliament name the concrete facts upon demanding deterrence of the Judges. “When N. Gvaramia was the Minister of Education, his first Deputy was the spouse of Vardzelashvili – one of the Judges of the Board. The second Judge – Kopaleishvili was the Deputy of N. Gvaramia when he was the Minister of Justice”.

Case distribution random principle was established to prevent distrust to Judges. That’s why, the immunity of the Judges increased.

As Gedevan Popkhadze stated, speaking of N. Gvaramia, if anyone’s position is not acceptable, it shall be made within the corrective form.
