As announced at the Bureau, the import, export, manufacture and sale of pyrotechnic products in Georgia shall be admitted based on the permit/license under the changes to the Code of Administrative Offenses and companion Bills, submitted in an expedited manner to the Parliament.

The legal initiatives establish administrative penalties for the non-fulfillment of the new regulations governing the import and sale of pyrotechnics.

In line with the Draft Law, three new Articles are being introduced to the Code of Administrative Offenses, envisaging administrative liability for the actions related to the import, export, manufacture and/or sale of pyrotechnics in Georgia:

 

import, export, manufacture and/or sale of pyrotechnics in Georgia without respective permits/licenses shall be subject to the fine of 5000 GEL, with or without confiscation of the offense items;

recurrence shall be subject to the penalty of 6000 GEL with or without confiscation of the offense items;

the violation of the permit/license terms by the permit/license holder concerning the import, export, manufacture and/or sale of pyrotechnics shall be subject to the penalty of 2000 GEL with or without confiscation of the offense items;

despite the liabilities imposed for the violation of the hereof terms, the failure of the permit/license holder to fulfill the permit/license terms within the established term shall entail the penalty increased three times, and recurrence - the annulment of the permit/license;

the sale of the pyrotechnics to the persons not holding the right to use the heroef products in line with the legislation shall be subject to the penalty of 2000 GEL;

recurrence by the aforementioned persons shall entail the fine of 3000 GEL;

the acquisition, holding and/or use of pyrotechnics by the persons not holding the respective rights shall be subject to the penalty of 1000 GEL with confiscation, and recurrence - 2000 GEL with or without confiscation.

Besides, the violation of the regulations on the registration, storage, transportation or use of the explosive, flammable, acute substances or pyrotechnics, as well as the illegal transfer thereof via mail or cargo, which will entail grave consequences, shall be attributed to the criminal liability and subject to penalty or home arrest with a term from 6 months to 2 years, or detention term - 2-5 years.

The Draft Law includes the modification of terms, namely, the term “pyrotechnic device” shall be replaced with “pyrotechnic product”.

The Draft Law envisages the enactment of the Law as of April 1, 2025, since the norms of the Draft Product Safety and Free Movement Code, which were reflected in the Draft, become effective as of April 1, 2025.
