The Draft Criminal Procedure Code adopted for the I reading

The Parliament adopted the Draft Criminal Procedure Code with 79 votes against 1.


Pursuant to the amendments, the norm shall be extracted which prohibits the questioning or interrogation of a person with disabilities, who, due to the disorders, is unable to properly perceive, remember or recall the circumstances of the case or provide information or testament.


At the same time, a new norm is introduced, which envisages the consideration, along with other circumstances upon the assessment of the reliability of the testaments, the ability of a person to properly perceive, remember or recall the circumstances.


As the Chair of the Human Rights and Civil Integration Committee, Mikheil Sarjveladze noted, the best standard of protection of the rights of persons with disabilities implies the fact when such persons, by considering their abilities, are allowed to participate in any litigations or proceedings, if it is not a restriction entailed by any objective or insurmountable needs.


“But when possible to engage a person with disabilities as a party or a witness, it shall be ensured and guaranteed under the law”, - he noted.
